Liability Waiver for S&S Industries Automotive Spray Painting Booth Rental 

Please read this liability waiver carefully before using the S&S Industries automotive spray painting booth for your projects. By signing this waiver, you acknowledge and agree to the following terms and conditions: 

 

Assumption of Risk: 

You understand that the use of the automotive spray painting booth involves inherent risks, including but not limited to exposure to chemicals, paint fumes, and potential risks associated with using equipment. You voluntarily assume all such risks and agree that S&S Industries shall not be held liable for any injuries, illnesses, or damages that may arise from your use of the facility. 

 

Compliance with Safety Regulations: 

You agree to comply with all safety regulations and guidelines provided by S&S Industries while using the spray painting booth. This includes wearing appropriate personal protective equipment (PPE) such as goggles, respirators, gloves, enclosed footwear, and coveralls. Failure to adhere to safety regulations may result in immediate termination of your rental and may lead to legal action if any damages or injuries occur. 

 

Proper Use of Equipment: 

You certify that you are knowledgeable and skilled in the proper use of automotive spray painting equipment. You agree not to use the equipment beyond its intended purpose and capacity. S&S Industries shall not be responsible for any accidents or damages resulting from improper use of the equipment. 

 

Use of S&S Industries Paint Products: 

You are encouraged to use paint products supplied by S&S Industries during your rental period. If S&S Industries' products are used, Customer will be issued with a $50 dollar S&S voucher and be provided 10% discount on all purchases. Any use of unauthorized paint products is at your discretion, but S&S Industries cannot be held liable for the quality or performance of non-approved paint products.

 

Release of Liability: 

In consideration of the use of the automotive spray painting booth and S&S Industries' paint products, you hereby release, discharge, and hold harmless S&S Industries, its employees, agents, and representatives, from any and all claims, liabilities, demands, actions, or rights of action, which are related to, arise out of, or are in any way connected with your use of the facility, equipment, or paint products. This release includes any damages, injuries, or losses that may be sustained by you or your property. 

 

Indemnification: 

You agree to indemnify and hold harmless S&S Industries from and against any and all claims, liabilities, demands, actions, or rights of action, including reasonable attorney's fees, which may arise from your use of the automotive spray painting booth or from any breach of this liability waiver. 

 

Inspection of Projects: 

S&S Industries reserves the right to inspect the projects you intend to paint within the facility. If, upon inspection, it is determined that the project poses an unreasonable risk to the facility, other users, or violates any applicable laws or regulations, S&S Industries may refuse the rental or request modifications to the project. 

 

Damage to Property: 

You are responsible for any damages caused to the automotive spray painting booth, equipment, or property of S&S Industries during your rental period. You agree to report any damages immediately to S&S Industries, and you will be liable for the costs of repair or replacement. 

 

Age Requirement: 

You must be at least 18 years of age to rent and use the automotive spray painting booth. If you are under 18, a legal guardian must sign this waiver on your behalf. 

 

Clean-up Charge:

You are responsible for cleaning up the automotive spray painting booth, equipment, or property of S&S Industries at the conclusion of your rental period. You agree that you will be charged an additional $80 if you have failed to adequately clean the Spray Booth after use. 

 

Overtime Charge: 

You acknowledge that the Booking Period is strictly limited. If you fail to vacate the Spray Booth by the end of the Booking Period, you agree to pay an additional charge of $100 for each hour that you occupy the Spray Booth beyond the agreed-upon end time.

 

By signing this liability waiver, you acknowledge that you have carefully read and fully understand its contents. You agree to be bound by its terms and conditions and acknowledge that this waiver shall be binding upon your heirs, executors, administrators, and assigns.
